The Physio Forum (Physiobob.com) Terms & Conditions

By using this site, you ("the Client") have agreed to the Terms and Conditions ("Conditions") of use with Performance Physio Ltd ("The Physio Forum") who provide their advice service ("the Advice Service") on this website ("physiobob.com"). Please do not use this site if you do not agree to all of the Terms and Conditions of this agreement. We may revise the Terms and Conditions in the future.

Information contained within this site can at no time replace the expertise of a qualified professional in a clinical setting. The content of this website is provided for information only and is not intended to be used or relied upon for diagnosis or treatment or as a substitute for consultation with any health professional, doctor, physiotherapist or specialist. The Physio Forum is not intended to and should not be used to issue or determine the suitability of any medication.

The Physio Forum recommends seeking professional advice before embarking on any form of self treatment. Provision of Online Advice

We will only provide online advice if the member is 18 years or over. Once we have evaluated the assessment sent by the member, we may decide we are unable to provide an acceptable level of treatment advice, in which case we will give the member a full explanation & refund.

By nature of the fact that the advising physiotherapy moderators are not in direct contact with the member asking a question, the Advice Service cannot meet the needs of every forum member. The Physio Forum will endeavour to provide online advice based on the information supplied in the medical questionnaire and posting information along with any supplementary questions requested by the assigned moderator. However if the moderators feel they cannot provide a reasonable level of advice The Physio Forum will not proceed with the treatment & suggest that the member take alternative courses of action. In this case any paid advice fee will be refunded.

Online physiotherapy advice can never be as comprehensive as a face to face appointment with a registered physiotherapist. By accepting the terms and conditions of posting on The Physio Forum you fully understand that the people answering the questions are only providing commentary based on their opinions that are gained from the information presented to them by the member. Any and all advice must be treated as a suggested progression to a face-to-face assessment and treatment.

Paid answers will be advised by registered physiotherapists (Australia or United Kingdom) whose registration has been checked by Performance Physio Ltd. None Paid postings (free postings) and comments on paid postings from non-paid moderators can come from anyone. Doe to the expansive nature of the membership you acknowledge that The Physio Forum cannot possible check on the education and relevant experience of each member. You also acknowledge that comments and advice can come from members in many different countries who have varying levels of education. As a result you agree to consider each bit of advice as something to take to your local physiotherapist or other registered health care professional, and NOT something to act on in isolation.

Consent

You signify your consent to these Terms by using this Web Site. We may alter these Terms by making changes to this web page at our discretion and without notice. By continuing to use this Web Site you accept these Terms as they apply from time to time.

Purpose and nature of our free content

a. Not personal treatment: Our content is intended as general information only. It is not intended to be comprehensive, and must not be relied upon as a substitute for "in person" physiotherapy or other medical treatment. You should organise a personal consultation with a suitably qualified medical professional before acting or relying on any content.
b. No guarantee of currency: We attempt to ensure that our free content is current and based on the latest research and industry practice as at the date of initial publication, but we do not guarantee its currency.

Our legal relationship with you

a. No duty of care: We do not assume any duty of care in relation to you or any other third party by providing the content on this website.
b. No practitioner/client relationship: Mere use of this Web Site or content is not intended to, and does not, create a practitioner-client relationship between you and us.

Liability

To the maximum extent permitted by law, we exclude any liability to you for any loss, damage, claims or costs (whether indirect, incidental, special, consequential or otherwise), including those associated with -

a. loss of business, income or profits;
b. pain and suffering;
c. the need to obtain medical treatment or rehabilitation or equipment;

resulting from the use of this Web Site. To the maximum extent possible, this exclusion applies to liability, loss or damage arising under in tort, contract, negligence, under statute or otherwise.

Where liability cannot be excluded, any liability incurred by us in relation to the use of this Web Site or the free content is limited to the re-supply of the services or the content.

Refunds Initiated by the Member

If for any reason your delivered advice service does not conform to the sale of goods act 1979 we will be happy to issue a credit or refund.

Refunds Initiated by The Physio Forum

If, after receiving the assessment & payment, The Physio Forum deem that they cannot provide a reasonable level of advice to a member, they will provide a full refund & explain the reasons.

Delivery

We will endeavour to advise on paid for threads (questions) to members within 48 hours (working days) of the assessment being received, or, if applicable, within 24 hours (working days) of the subsequent questions raised by the advising moderator being answered by the member. For the purpose of this agreement, working days exclude Saturdays, Sundays & UK Public holidays. As part of the online advice, The Physio Forum will send the member periodic prompts to the members email address. This relies on the member accepting emails from Administrators and Moderators in their profiles.

Dealings with advertisers & merchants

The Physio Forum may contain advertisements for other sites and companies. Unless stated we do not endorse any product linked to or advertised on physiobob.com. The Physio Forum makes no assurances or warranties (expressed or implied) about the accuracy, completeness or reliability of any advertisement links to and from other sites.

Links to / from other sites

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because The Physio Forum has no control over such sites and resources, you acknowledge and agree that The Physio Forum is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

Limited liability

To the fullest extent permitted by applicable laws, and except in respect of death or personal injury arising from The Physio Forum negligence, The Physio Forum hereby excludes liability for any claims, loss, demands or damages of any kind whatsoever with respect to the Service, and any information, content, advertisements or products provided or distributed through the Service including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to The Physio Forum. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise. If you are a consumer your statutory rights, if any, are not affected.

Indemnity

By using the Service you agree to defend, indemnify and hold The Physio Forum, its officers, partners, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Content in a manner that violates or is alleged to violate these Conditions.

General

These Conditions constitute the entire agreement between you and The Physio Forum and govern your use of the Service, superseding any prior agreements between you and The Physio Forum. The Conditions and the relationship between you and The Physio Forum shall be governed by the laws of England. You and The Physio Forum agree to submit to the exclusive jurisdiction of the English courts. Any failure by The Physio Forum to exercise or enforce any right or provision of the Conditions shall not constitute a waiver of such right or provision. If any provision of the Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Conditions remain in full force and effect.
