Legal aspects of home assessment

Heya,

I have been set a group presentation which involves a home assessment and home treatment. The woman in the case study is 10/12 post stroke and has poor balance and other safety concerns.

We were wondering what the protocol for this would be. If she fell during our sessions who would be responsible, would it be us a physio or the patient as it is her own home?


Any help would be greatly appreciated!!

Hi,
a good question.
Why are you concerned about who's responsibility a fall or injury is? Does your country not offer no-fault accident health care? Or are you worried about the client suing you after the accident? Or are you worried about loosing your license?

The simple answer to your question is: It depends on whatever is written in your rehabilitation agreement/contract and consent form, which the client has signed.

And if you are negligent in your practice , then it's your fault.

Thank you. Now you say that we should be covered even if it isn't our fault, it seems really obvious.

Basically we need to say we have covered every legal aspect and weren't sure what that would be. I guess the CSP would cover us if we weren't to blame. But, yes the main concern was if she tried to sue us, of course we would try our best to not let this happen.
